These Terms and Conditions (“Terms”) govern access to and use of the NextGen Labs website and any purchase of products from NextGen Labs (“we,” “us,” “our”). By accessing the site or placing an order, you agree to these Terms.
If you do not agree, do not use the site or purchase products.
- Research use only
All products sold by NextGen Labs are laboratory research reagents supplied for research use only.
They are not:
- approved by Health Canada for human or veterinary use
- drugs, medicines, supplements, or cosmetics
- intended for human consumption, injection, implantation, or administration of any kind • intended for diagnostic, therapeutic, or clinical use
By ordering, you confirm that:
- you are purchasing for lawful laboratory or research purposes only
- you will not use the products in or on humans or animals
- you are solely responsible for compliance with Canadian federal, provincial, and institutional rules that apply to you
A high purity percentage, a Certificate of Analysis, or published scientific literature does not make a product approved for human use.
- Eligibility
You must be at least 19 years of age (or the age of majority in your province or territory, whichever is higher) to place an order.
You represent that you have the legal capacity to enter a binding contract and that the information you provide is accurate.
We may refuse, cancel, or limit any order at our discretion, including where we reasonably believe the intended use is inconsistent with these Terms.
- Canada-only sales and shipping
NextGen Labs ships only to addresses in Canada.
We do not ship outside Canada. We do not accept international orders, freight-forwarding addresses intended to export goods, or instructions to ship onward outside Canada. If an order is placed with a non-Canadian shipping address, it may be cancelled and refunded less any non-recoverable fees.
- Orders, pricing, and payment
Product descriptions, vial sizes, and prices are displayed in Canadian dollars unless stated otherwise. Prices may change without notice until an order is accepted.
An order is an offer to buy. We accept the offer when we confirm the order and/or dispatch the goods.
We may correct obvious pricing or listing errors and cancel the affected order. Payment is due at checkout using the methods shown on the site. You authorize us to charge the selected method for the order total, including applicable taxes and shipping. Title and risk of loss pass to you when the carrier collects the package, except where consumer-protection law in your province requires otherwise.
- Taxes
Applicable GST/HST/PST will be calculated at checkout based on the shipping address, where required.
You are responsible for any taxes not collected at checkout that lawfully apply to your purchase.
- Shipping and delivery
In-stock orders are typically processed within 24 hours. Delivery times across Canada vary by destination and service.
A tracking number is provided when the order ships.
Delivery estimates are not guarantees. Delays caused by the carrier, weather, labour disruptions, or incorrect address information are outside our control.
You must provide a complete, deliverable Canadian address. We are not responsible for packages marked delivered by the carrier, left at the address, or lost after a “no signature” release you requested.
If you believe a shipment is lost or damaged in transit, contact us promptly with the order number and photos of the packaging and contents.
- Packaging
Orders are packed to protect lyophilized vials in transit. Outer packaging is discreet. Product names are not printed on the outside of the carton.
- Returns, refunds, and cancellations
Research reagents are sold as final sale once dispatched, except where required by applicable consumer-protection law.
You may request cancellation before the order is packed or handed to the carrier. After dispatch, cancellation is generally not available.
- We will review claims for: wrong item shipped
- vial received broken or leaking on arrival
- material that does not match the batch documentation we supplied
Report these issues within 24 HOURS of delivery, with photos, the order number, and the lot number on the vial. Do not discard packaging until the claim is reviewed. If we confirm an error or transit damage attributable to us or the carrier, we may, at our option, replace the item or refund the purchase price of the affected item.
We do not accept returns because you changed your mind, ordered the wrong product, or no longer need the material.
Opened, reconstituted, or tampered vials are not eligible for return.
- Quality, testing, and Certificates of Analysis
We target high analytical purity (typically ≥99% by HPLC, with identity confirmation) for research peptides, as described on the site.
Each relevant batch is associated with a Certificate of Analysis (COA) or equivalent lab documentation when available. Lot numbers on vials should be matched to the corresponding report.
COAs describe analytical results for the tested sample. They are not a warranty of fitness for any particular experiment, protocol, or result.
Storage, handling, reconstitution, and laboratory technique after delivery are your responsibility. Improper storage can degrade material regardless of the purity reported at release.
- Storage and handling
Products typically ship as lyophilized powder. Follow the storage guidance on the product page, label, and COA.
We do not provide medical advice, dosing instructions, or protocols for human use. Any reconstitution information on the site is general laboratory handling information only.
- Prohibited conduct
You agree not to:
- purchase products for human or veterinary use
- resell products as medicines, supplements, or “for human use” goods
- misrepresent your identity, age, or shipping address
- use the site to commit fraud or violate law
- scrape, attack, or interfere with the website
- copy product text, images, logos, or COA layouts except as allowed for your own purchase records
We may suspend accounts and cancel orders that appear to violate these Terms.
- Intellectual property
The NextGen Labs name, hexagon logo, slogan “PRECISION PURITY PERFORMANCE,” product photography, site design, and written content are owned by us or our licensors.
You may not use our branding in a way that suggests we approve human use, medical claims, or an affiliation we have not authorized.
- Website content
Product pages, FAQs, and educational text are for general information about research materials. They are not medical, legal, or professional advice.
We try to keep listings accurate. Images are illustrative. Actual vial appearance, cap colour, and label layout may vary by batch.
- Disclaimer of warranties
To the maximum extent permitted by applicable law, products and the website are provided “as is” and “as available.”
We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non infringement, except those that cannot be excluded under the law of your province. We do not warrant that use of any product will produce a particular experimental result.
- Limitation of liability
To the maximum extent permitted by applicable law:
- NextGen Labs is not liable for indirect, incidental, special, consequential, punitive, or lost profit damages
- we are not liable for misuse, off-label use, human or animal administration, improper storage, or results of your research
- our total liability for any claim relating to an order is limited to the amount you paid for the specific products giving rise to the claim
Some provinces do not allow certain limitations. In those provinces, our liability is limited to the greatest extent permitted.
Nothing in these Terms excludes liability that cannot legally be excluded (including liability for fraud or for death or personal injury caused by negligence, where that rule applies).
- Indemnity
You agree to indemnify and hold harmless NextGen Labs and its owners, employees, and contractors from claims, losses, and expenses (including reasonable legal fees) arising out of:
- your misuse of products
- your breach of these Terms
- your violation of law
- any claim that you used or promoted products for human or veterinary use
- Privacy
Personal information is handled as described in our Privacy Policy. Payment data is processed by the payment providers shown at checkout.
- Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts located in British Columbia have exclusive jurisdiction, except where consumer protection law in your province requires otherwise.
- Changes
We may update these Terms at any time by posting a new version on the site. The “Last updated” date will change. Continued use after posting constitutes acceptance of the revised Terms. Orders already accepted remain subject to the Terms in effect at the time of acceptance, unless a change is required by law.
- Severability
If a provision is found unenforceable, the remaining provisions stay in effect.
- Entire agreement
These Terms, the order confirmation, and any policies linked from the site (including the Privacy Policy and Shipping/Returns policy) are the entire agreement between you and NextGen Labs for website use and product purchases.
